Brownfield Assessment and Remediation Project
Cameron-Cole was retained by a group of developers to prepare a Site Assessment Report in accordance with the Brownfields Cleanup Criteria Rule, Chapter 62-785 of the Florida Administrative Code, and to assist in securing a Brownfield designation for the property. Known as the Inland River Transportation property, it comprised 2.5 acres of waterfront land in downtown Pensacola that had been unoccupied for nearly 20 years due to environmental concerns.
Cameron-Cole developed a comprehensive Brownfield Site Assessment Report and assisted the developers in obtaining a formal Brownfield Designation from the local municipality. The Florida Department of Environmental Protection (FDEP) approved the Site Assessment Report without comment following the property's designation as a Brownfield site.
The assessment identified the presence of metals in the surface soils at concentrations that exceeded the established cleanup criteria for direct exposure. However, no groundwater impacts were identified, and the data did not show that the metals had a high leaching potential. In addition, due to the proximity of the site to the Gulf of Mexico, current building codes required increasing the elevation of any new construction by approximately 4 feet. Working closely with the development team, Cameron-Cole prepared a Remedial Action Plan (RAP) to address the identified soil contamination by incorporating the use of an engineered soil cap to mitigate the potential for direct exposure to the impacted soil while simultaneously increasing the elevation the site. Since the soil cap was an integral component of the site rehabilitation, the developers qualified for Voluntary Cleanup Tax Credits from the state Brownfields Program which off-set the costs of importing and placing the clean fill material. Throughout the process, Cameron-Cole maintained a high degree of communication with the municipality, regulatory agency, and participated in Brownfields Committee and other meetings to keep all stakeholders informed of the project's progress. The property has now been re-developed with a waterfront restaurant and professional office building
By proactively collaborating with the development team early in the process, Cameron-Cole was able to identify a remedial alternative that could be incorporated into the overall property re-development plans while also meeting the applicable regulatory requirements for site rehabilitation under the brownfields cleanup rule.
